ELIGIBILITY: NO PURCHASE NECESSARY TO ENTER OR WIN. 2006 First Kick Challenge Sweepstakes (the "Sweepstakes") is open to legal residents of the United States (except Rhode Island, Puerto Rico, Guam, U.S. Virgin Islands, and all other U.S. and foreign territories and possessions, and excluding where otherwise prohibited by law, rule or regulation) who are 18 years or older at the time of entry. Employees, officers, and directors (including immediate family members and members of the same household) of Major League Soccer, LLC ("MLS" or the "Sponsor"), (collectively, the "MLS Entities"), the SOE Entities (defined below) and each of their affiliated companies, subsidiaries, licensees, distributors, dealers, retailers, printers and advertising and promotion agencies, and any and all other companies associated with the Sweepstakes are not eligible to participate. Online entrants to the Sweepstakes will be given the option to receive commercial e-mails from MLSnet.com; however, eligibility to participate in the Sweepstakes is not dependent upon entrant's consent to receive such e-mails. The Sweepstakes is subject to all applicable federal, state, local laws and regulations. Void where prohibited or restricted by law.
HOW TO ENTER: The Sweepstakes begins at 5:50 p.m. Eastern Time ("ET") on March 14, 2006 and ends at 2:00 p.m. ET on Saturday, April 1, 2006 ("Entry Period"). During the Entry Period, go to www.MLSnet.com and click on the banners, buttons and/or links to access the online entry form for the Sweepstakes. By submitting your complete name, date of birth, ZIP/postal code and e-mail address via the online entry form, you will be automatically entered in the Sweepstakes. Each entry must also contain, in addition to the personal information specified above, the entrant's guess as to six results (e.g., the winning team or tie) of the following 2006 Opening weekend games: (a) FC Dallas v. Chicago Fire to be played at 4:00 pm ET on April 1, 2006, (b) K.C. Wizards v. Columbus Crew to be played at 8:30 p.m. ET on April 1, 2006, (c) L.A. Galaxy v. New England Revolution to be played at 11:00 pm. ET on April 1, 2006, (d) D.C. United v. New York Red Bulls to be played at 5:00 p.m. ET on April 2, 2006, (e) Chivas USA v. Real Salt Lake to be played at 8:00 p.m. ET on April 2, 2006, and (f) Houston Dynamo and Colorado Rapids to be played at 7:30 p.m. ET on April 2, 2006 ((a) through (f), collectively the "Games"). All information submitted by entrants is subject to MLSnet.com's Privacy Policy accessible at: http://www.mlsnet.com/about/privacy.jsp. Entrants must complete all non-optional data requested on the online entry form. Incomplete entries are void. No other method of entry will be accepted. Limit one entry per person.
RANDOM DRAWING:
Grand Prize Winner: The individual who completes an eligible entry and correctly guesses the six results (e.g., the winning team or tie) of the Games will be the Grand Prize winner. Official MLS scorers, at their sole discretion, will determine the final result of the Games. No more than one (1) Grand Prize will be awarded. If more than one (1) eligible participant is eligible for the Grand Prize, only one (1) Grand Prize will be awarded via a random drawing on or about April 14, 2006 from among all eligible entries who correctly guessed the six results of the Games..
All prizes will be awarded. Limit one prize per person, family or household. All decisions of Sponsor are final and binding on all matters relating to this Sweepstakes. Odds of winning depend on the total number of eligible entries received.
Second Chance Drawing(s): If no entrant correctly guesses the six results (e.g., the winning team or tie) of the Games, second chance drawings will be held to award the Grand Prize. All entrants who entered the Sweepstakes during the Entry Period will be eligible for the Second Chance Drawing(s). If Second Chance Drawing(s) are necessary, on or about April 28, 2006, one (1) Second Chance Grand Prize winner will be selected at random from among all eligible entries received. The odds of winning Second Chance Prize are dependant upon number of eligible entries received.
PRIZES: There will be one (1) Grand Prize winner.Grand Prize: One (1) eligible Grand Prize winner will win one (1) official 2006 MLS team jersey autographed by the winner's player of choice. The player of choice must be on a 2006 opening day MLS roster. If the Grand Prize winner's first choice of players is unavailable, the Grand Prize winner will be allowed to select a second player of choice from the 2006 opening day MLS rosters (Total approximate retail value of prize: $ 200.00.)
The Grand Prize (collectively, the "Prize") is non-transferable and non-assignable, with no cash redemptions or substitutions except at Sponsor's sole discretion. Sponsor, the other MLS Entities and the SOE Entities will not be responsible for Acts of God, acts of terrorism, civil disturbances, work stoppage or any other natural disaster outside their control that may cause the cancellation of MLS games. There will be no substitutions for the Grand Prize except due to unavailability, in which case, a cash prize of equal value to the face value of the Grand Prize will be awarded at the exclusive discretion of the Sponsor.
Each winner is fully responsible for any and all applicable federal, state, international and local taxes. All costs and expenses not specified herein, related to any Grand Prize, including but not limited to lodging, transportation costs, meals, taxes (including income taxes) and gratuities and other expenses incurred by accepting the Grand Prize are the sole responsibility of the winner.
NOTIFICATION: Each winner will be notified by e-mail by the Sponsor and/or SOE. In the event that any winner does not respond to any such notification within three (3) days, a disqualification will result and an alternate winner shall be chosen from among all remaining eligible entries. Each winner will receive Sponsor's Affidavit of Eligibility and Release of Liability which must be completed, notarized and returned within ten (10) days of receipt. A disqualification will result and an alternative winner will be randomly selected from among all remaining eligible entries if the Sponsor's Affidavit of Eligibility and Release of Liability are not properly returned within the specified period of time. Refusal or return of Sponsor's Affidavit of Eligibility and Release of Liability as non-deliverable will also result in disqualification and cause an alternative winner to be chosen from among all remaining eligible entries.
WAIVER OF LIABILITY/PUBLICITY RELEASE: By participating in the Sweepstakes and submitting an entry, all entrants agree to be bound by these Official Rules, including all entry requirements. By entering the Sweepstakes, each winner agrees to waive any and all claims against the Sponsor, the other MLS Entities, the SOE Entities and each of their respective agents and representatives for any personal injury, damage or loss that may occur from the participation in the Sweepstakes or from the receipt or use of any prize or travel related to the receipt or use of any prize, and each winner grants to Sponsor, the other MLS Entities and the SOE Entities the right to publicize such winner's name and/or likeness in any medium without additional compensation or consideration unless prohibited by law.
GENERAL CONDITIONS: The Sponsor, the other MLS Entities, the SOE Entities and each of their respective agents and representatives are not responsible for printing or typographical errors in any Sweepstakes-related materials; stolen, late or misdirected entries, lost, damaged, garbled, delayed, misdirected, damaged, incomplete, postage due or illegible entries. Sweepstakes entries generated by a script, macro or other mechanical or automated means will be disqualified. The Sponsor, the other MLS Entities, the SOE Entities and each of their respective agents and representatives are not responsible for incorrect, inaccurate transcription or loss or delay of entry or prize reply information, or any viruses transmitted to computers of participants via the Internet, or for any technical or human errors associated with the Sweepstakes. If, in the Sponsor's exclusive judgment, this promotion becomes compromised in any way, Sponsor reserves the right to withdraw the promotion offer, cancel any method of entry, to void any entries submitted fraudulently or select winners from all eligible entries received prior to act that compromised the promotion.
Any attempt to deliberately damage the content or operation of this Sweepstakes is unlawful and subject to legal action by the Sponsor, the other MLS Entities, the SOE Entities or their respective agents. Sponsor, the other MLS Entities and the SOE Entities shall have the sole right to disqualify any contestant for violation of these Official Rules or any applicable laws relating to the Sweepstakes, and to resolve all disputes in their sole discretion. Sponsor, the other MLS Entities and the SOE Entities (i) make no warranty, guaranty or representation of any kind concerning any prize, and (ii) disclaim any implied warranty. All disputes will be resolved under applicable U.S. laws in the County of New York, state of New York.
The Sponsor, the other MLS Entities and the SOE Entities reserve the right, in their sole discretion, to cancel or suspend the Sweepstakes should virus, bugs, unauthorized human intervention, or other causes beyond the control of the Sponsor, the other MLS Entities or the SOE Entities corrupt administration, security, fairness, integrity or proper operation of the Sweepstakes. In the event of cancellation, Sponsor may elect to identify winners and award the prizes by way of random drawing from among all entrants who had entered the Sweepstakes at the time of such cancellations.
All entries must include a valid e-mail address for the entrant. In case of multiple entries, only the first entry received will be considered. In the event of a dispute as to the identity or eligibility of a winner based on an e-mail address, the winning entry will be declared made by the "Authorized Account Holder" of the e-mail address submitted at the time of the entry. The "Authorized Account Holder" is the person to whom the applicable Internet service provider or other organization (such as business or educational institution) has assigned the e-mail addresses for the domain associated with the submitted e-mail address.
The "SOE Entities" shall mean SportsOnEarth, L.L.C. ("SOE"), MLB Advanced Media, L.P. and Tickets.com, Inc.
WINNERS' LIST: For a list of winners, mail a self-addressed stamped envelope to: 2006 First Kick Sweepstakes, c/o Major League Soccer, LLC, 420 5th Avenue, 7th Floor, New York, NY 10018. Winner's list requests must be made by September 1, 2006.
